Letter dated 23 April 1998 from the head of the delegation of
the United States of America to the fifty-fourth session of
the Commission on Human Rights addressed to the Chairman of
the Commission on Human Rights


On 15 April 1998, Ambassador George E. Moose of the United States provided the United States Government's oral response to the report by Mr. Bacré Waly Ndiaye, Special Rapporteur on extrajudicial, summary, or arbitrary executions, regarding his mission to the United States of America (E/CN.4/1998/68/Add.3). As Ambassador Moose indicated at that time, we highly value the role of special rapporteurs of the Commission on Human Rights, and it was thus essential for us to provide a detailed response to the report.

I am pleased to provide the attached* response. It will, in our view, provide a more complete and detailed statement of the United States legal process and the protection of the rights of defendants in capital punishment cases. It should be read in conjunction with the Special Rapporteur's report to obtain a fuller and more balanced picture.

It is requested that the response be circulated as a document of the Commission on Human Rights.
